RULES OF SERVICE PROVISION OF THE ELECTRONIC STORE GDAY.LT
1. CONCEPTS
1.1. Seller – MB Geros dienos kava, registered office address Jankiškių g. 2-218, LT-02300 Vilnius, Lithuania, JAK 304939070, VAT number LT100014232010, contacts: labas@gday.lt , +37067256994.
1.2. Gday.lt – an electronic store, at the internet address https://www.gday.lt .
1.3. Buyer – 1) a natural person who, in accordance with applicable legal acts, is able to conclude transactions and who purchases goods for personal use (not for business purposes), 2) a legal person of the Republic of Lithuania who purchases goods as an end user (intending to use the goods for representational or other purposes not related to the resale of goods or their use for business, production or provision of services; 3) duly authorized representatives of all the above-mentioned persons.
1.4. Parties – Buyer and Seller jointly.
1.5. Seller's partner - a legal entity: 1) used to fulfill the Buyer's order; 2) with which joint promotions or projects are carried out on Gday.lt, on the websites of this legal entity or in any media where the promotion or project of Gday.lt and this legal entity will be described or announced.
1.6. Rules – these terms and conditions of the services of the e-store gday.lt.
1.7. Product – everything that is sold in the Gday.lt online store: coffee beans for the home and coffee making equipment and accessories.
2. GENERAL PROVISIONS
2.1. These Rules are a legal document binding on the Parties, which establishes the rights and obligations of the Parties, the conditions for purchasing and paying for goods, the procedure for delivering and returning goods, and other conditions related to the purchase and sale of goods on Gday.lt.
2.2. The Seller reserves the right to change, supplement, or amend the Rules at any time. The new version of the Rules shall enter into force upon its publication on Gday.lt. Buyers have the opportunity to familiarize themselves with the valid version of the Rules on the Gday.lt website, and are also informed each time during the purchase of the Goods.
2.3. All persons specified in clause 1.3 of these Rules have the right to register and purchase goods on Gday.lt after confirming that they are familiar with the Rules (clause 2.4 of the Rules). By confirming that they are familiar with the Rules, Buyers at the same time confirm that they have the right to purchase goods on Gday.lt, i.e. they comply with the definition of Buyer specified in the Rules.
2.4. The Buyer acknowledges his/her familiarity with the Rules and agrees to abide by them by checking the box next to the statement: "I have familiarized myself with the rules for the sale of goods in the Gday.lt online store and I AGREE WITH THEM". The Buyer has the option to agree or disagree with the statement specified in this clause of the Rules when making a purchase in the Gday.lt online store.
2.5. If the Seller has the right or obligation to provide information or documents to the Buyer by e-mail, in all cases the Buyer is responsible for providing the Seller with a valid e-mail address belonging to the Buyer.
3. ORDERING GOODS, CONCLUSION OF A PURCHASE-SALE AGREEMENT
3.1. The legal relationship of purchase and sale between the Seller and the Buyer arises and the purchase and sale agreement (hereinafter referred to as the Agreement) between them is considered concluded from the moment when the Buyer, having selected the product(s) to be purchased in the Gday.lt online store and created a shopping cart, completes all the steps of the order.
3.2. Buyers' orders are registered and stored in the database of the online store Gday.lt on the Wix.com platform in accordance with the rules of the Wix.com platform.
4. BUYER'S RIGHTS
4.1. The Buyer has the right to purchase goods in the Gday.lt online store in accordance with the procedure established in these rules.
4.2. The Buyer has the right to cancel the order in accordance with the procedure established by these Rules.
4.3. The Buyer has the right to withdraw from the Agreement concluded online with Gday.lt, but no later than within 14 (fourteen) days from the date of delivery of the goods. Except for food products.
4.4. The Buyer has the right to exchange or return the purchased goods in accordance with the procedure established by these Rules.
4.5. The Buyer has other rights provided for in these Rules, the Privacy Policy, and the legal acts of the Republic of Lithuania.
5. SELLER'S RIGHTS
5.1. The Seller has the right to suspend or terminate the activities of Gday.lt. In such a case, all accepted and confirmed Buyer orders shall be completed and new orders shall not be accepted.
5.2. The Seller has the right to cancel the Buyer's order when:
5.2.1. The Buyer does not pay for the goods on time,
5.2.2. The goods are no longer in stock,
5.2.3. The Buyer submits a request to cancel the order. For food products - no later than 1 (one) business day from the date of payment for the order,
5.2.4. The Buyer fails to comply with the Buyer's obligations provided for in these Rules and/or the legal acts of the Republic of Lithuania relevant to the transaction.
5.3. When the Buyer selects the intended payment or delivery method, the Seller, in the event of any uncertainty regarding the information provided in the order, has the right to contact the Buyer using the contacts specified in the order.
5.4. The Seller has other rights provided for in these Rules or legal acts of the Republic of Lithuania.
6. BUYER'S OBLIGATIONS
6.1. The Buyer must pay for the purchased goods on time and accept them in accordance with the procedure established in these Rules.
6.2. The Buyer undertakes to store and not transfer to third parties his/her login data to the online store Gday.lt. The Buyer is responsible for the consequences arising from improperly stored login data.
6.3. Buyers of the online store Gday.lt must familiarize themselves with these Rules and the Privacy Policy, as well as comply with them and other conditions clearly specified in the online store, and not violate the legal acts of the Republic of Lithuania.
7. SELLER'S OBLIGATIONS
7.1. The Seller undertakes to provide access to the services of the online store, the operating conditions of which are determined by these Rules and other conditions provided for by Gday.lt.
7.2. The Seller undertakes to deliver the goods purchased by the Buyer to the specified address (deliveries are not made to the Curonian Spit), in accordance with these Rules.
7.3. The Seller undertakes to respect the Buyer's right to privacy regarding his/her personal information, i.e. to process the Buyer's personal data only in accordance with the procedure established by the Rules, Privacy Policy and legal acts of the Republic of Lithuania.
7.4. Under the conditions provided for in the Rules, the Seller undertakes to deliver the goods ordered by the Buyer and to accept the goods returned by the Buyer.
7.6. When the Buyer returns the goods, the Seller undertakes to refund the money paid by the Buyer within 10 (ten) business days from the date of return of the goods to the Seller.
8. PRICES OF GOODS, PAYMENT TERMS AND PROCEDURE FOR GOODS
8.1. Prices of goods in the Gday.lt online store are indicated in euros including VAT.
8.2. The Buyer shall pay for the purchased goods in one of the following ways:
8.2.1. By manual transfer - if this payment method is chosen, the Seller sends the Buyer a prepayment invoice to the email address specified during the purchase. The product is prepared and sent to the Buyer only after payment is received.
8.2.2. Payments can be made using Swedbank, SEB, Luminor, Citadele and Šiaulių bankas electronic banking services. Payments are available in euros. Payments are processed using the MakeCommerce.lt payment platform.
8.2.3. by transfer from a PayPal account in the e-store.
9. DELIVERY AND COLLECTION OF GOODS
9.1. Having chosen the delivery service, the Buyer undertakes to provide the Seller with the exact delivery address.
9.2 The Buyer undertakes to accept the goods himself or to designate another recipient of the parcel.
9.3. The Goods may be delivered to the Buyer or a person designated by the Buyer by the Seller himself or by his authorized representative.
9.4. If the Buyer selects a courier service when ordering:
9.4.1. The Buyer undertakes to indicate the exact place of delivery of the goods.
9.4.2. The Buyer undertakes to accept the goods himself. When accepting the goods, it is necessary to present a valid personal identification document (identity card, passport or new driver's license). If the Buyer cannot accept the goods himself, and the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller for the transfer of the goods to the wrong person.

9.6. The Seller reserves the right to change the delivery fee and the purchase amount above which delivery is free. The current prices are indicated in the order creation window so that the Buyer has the opportunity to familiarize themselves with them before confirming the order.
9.7. The goods are sent to the Buyer or the person specified by him to the exact address specified after receipt of payment, therefore the delivery period begins to be calculated from the receipt of payment for the goods(s).
9.8. The Seller undertakes to make every effort to deliver the purchased item as quickly as possible.
9.9. The Seller is exempt from liability for violation of the terms of delivery of goods if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties or due to circumstances beyond the control of the Buyer.
9.10. The Buyer, having received the goods at the specified address, must, together with the Seller or his authorized representative, check the condition of the shipment and the goods(s) and sign the invoice, waybill or other document of transfer and acceptance of the shipment. After the Buyer signs the invoice, waybill or other document of transfer and acceptance of the shipment, it is considered that the shipment has been transferred in proper condition, and there are no damages to the goods, the cause of which is not attributable to a manufacturing defect, and there are no discrepancies in the configuration of the goods(s) (such as can be determined by examining the exterior of the goods). Having noticed that the packaging of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the goods(s) are damaged and/or the goods(s) are in an inappropriate configuration, the Buyer must note this on the invoice, waybill or other document of delivery and acceptance of the shipment and, in the presence of the Seller or its representative, draw up a free-form act of damage (non-conformity) of the shipment and/or goods(s).
9.11. If the Buyer fails to perform the actions specified in paragraph 9.10 of the Rules, the Seller shall be released from liability to the Buyer for damage to the goods, if the basis for such damage is not a manufacturing defect, and for discrepancies in the configuration of the goods, if these discrepancies can be determined by inspecting the exterior of the goods.
9.12. The characteristics of all goods sold are indicated in the description of each item. The Seller is not responsible for the fact that the color, shape, smell or other parameters of the goods in the online store may not correspond to the actual size, shape, color of the goods, the Buyer's imagination due to the characteristics of the monitor used by the Buyer, or the Buyer's subjective assessment.
9.13. The risk of accidental breakage or damage to the goods passes to the Buyer from the moment the goods are transferred to the Buyer.
10. COFFEE SUBSCRIPTIONS
10.1. The Buyer may purchase a subscription for two types of coffee products.
10.1.1. Coffee Flavor Subscription is a one-time payment service where the Seller delivers the Product to the same recipient's address according to the specified schedule. The duration of this service is 4 months and is not renewable.
10.1.2. Coffee subscription is a recurring purchase of a single product, for which funds are debited from the Buyer's account every month. Payment partner – MakeCommerce. Coffee subscription has no expiration date, i.e. it continues every month until it is terminated.
10.1.3. Coffee subscription cancellation conditions:
10.1.3.1. The Buyer no longer wishes to continue the subscription. The Buyer must inform the Seller of the desire to terminate the subscription. This can be done by contacting e-mail. labas@gday.lt or tel. no. +37067256994. In such a case, the subscription is immediately terminated and funds are no longer debited from the Buyer's account. Funds for debits made before the Seller's notification are not refundable. Products are delivered for all paid months.
10.1.3.2. Upon expiration of the product, the subscription shall be terminated by the Seller as soon as possible. The Seller shall inform the Buyer of the termination of the subscription and refund the funds paid for all months when the service is not provided no later than within 10 (ten) business days from the date of termination of the coffee subscription.
11. GIFT COUPONS
11.1. The Buyer may purchase a digital gift voucher. The digital gift voucher is sent to the specified email address,
11.2. The coupon can only be used in the gday.lt e-store. To do this, you need to enter the unique coupon number in the discount code window - in the payment section. The coupon is valid for one purchase.
11.3. The coupon is valid for 365 days.
12. FINAL PROVISIONS
12.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania and the European Union.
12.2. The law of the Republic of Lithuania shall apply to relations arising under these Rules.
12.3. All disagreements arising from the implementation of the Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
